General Information:

The Agreement of Purchase and Sale:

A written agreement or contract is required when you wish to purchase a home or vacant land. Generally if you are purchasing a property through a real estate agent the Agent will draft the agreement on a standard form agreement. In instances where an agent is not involved it will be necessary to have a lawyer prepare the Purchase Agreement. In either case the agent or lawyer can tailor the purchase and sales agreement to suit your needs.

Generally each party is represented by their own lawyer.

Purchase funds are held in trust by the purchasers’ lawyer until the sale is completed. A deed which conveys the property along with any access rights is then prepared by the Sellers lawyer and this is held in trust until the sale is complete.

 

Closing:

The exchange of the Deed for the agreed purchase price is called the closing. The date of closing is agreed upon in the Purchase and Sales Agreement. It is not required for the Purchaser to be physically present in Nova Scotia at the closing. This exchange is between the lawyers.

After the exchange the Purchaser’s lawyer then registers the deed in the Nova Scotia Land Registry office. This is a public record and proves to all that the property is yours. After closing the lawyer will send you a closing bundle of documents which will include the deed and a Statement of Recorded Interests which is obtained from the Nova Scotia Land Registry.
